Terms of Use

These Terms of Use govern Thumb Sumthing (ts.fbowl.io), operated by Da Vida LLC (“we”). By entering or playing, you agree to them. If you do not agree, please do not use the game.

1. You must be 18

Thumb Sumthing is an 18+ product. Tapping through the age gate is your representation that you are 18 or older; we record the time of that attestation. If that representation is false, your access ends and your data is removed under the Privacy Policy. Do not invite anyone under 18 to your group.

2. The game

Thumb Sumthing is a drawing-and-guessing game for private groups of people who know each other. Each group lives at a private link; whoever holds the link can be invited in through the gate. Keep your group’s link to people you trust — we can rotate a leaked link to a fresh address, and members keep access when we do.

3. Your content and our license

You own what you make here — your drawings and your guesses. You grant Da Vida LLC the limited license needed to run the game: to store, display, and render your content for your group. This license survives your departure or a deletion request for rounds your group already completed, so the archive your group built is not hollowed out retroactively; deletion removes your identity from it and removes all unfinished content. We claim no other rights in your work.

4. Content rules

Crude adult party humor is the point; it also has a ceiling. Sexually explicit content is not permitted anywhere in the product. The following are prohibited outright: any sexual content involving minors; non-consensual sexual content; content depicting or targeting a real person without their consent; harassment; hate; and anything illegal. Groups are for consenting adults who chose each other — content rules protect that, not replace it.

5. Enforcement

We may remove content, rotate or revoke group links, and suspend or terminate accounts to enforce these terms or the law, with or without notice. Repeat infringers are terminated. Where the law requires it, we preserve and report material to the appropriate authorities.

6. Copyright

If you believe content in the product infringes your copyright, send a takedown notice to hello@fbowl.io with the material identified, your contact information, and a statement of good-faith belief. Counter-notices go to the same address. We terminate repeat infringers.

7. Acceptable use

Do not probe, scrape, disrupt, or attempt to gain access to groups you are not a member of; do not guess or enumerate group links; do not use automated access; do not reverse engineer the service or use it in violation of any law.

8. Our property

The product — its name, design, and software — belongs to Da Vida LLC and is protected by applicable law. These terms grant you no rights to our trademarks or branding.

9. Disclaimer of warranties

Thumb Sumthing is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the game will be uninterrupted or error-free, or that content will be preserved indefinitely.

10. Limitation of liability

To the fullest extent permitted by law, Da Vida LLC is not liable for any indirect, incidental, special, or consequential damages, or any loss of data, arising from your use of the game.

11. Termination

You can stop playing at any time; leaving a group or requesting deletion works as described in the Privacy Policy. We may suspend or end the service, or your access to it, as described in section 5.

12. Governing law

These terms are governed by the laws of the State of Georgia, United States, and disputes belong to the state or federal courts located in Georgia.

13. Changes

If these terms materially change, the new version will be posted here with an updated effective date; continuing to play after that is acceptance of the change.
